Can't make it to the eula agreement when starting server [MC 1.16.5] [Forge 36.2.22]

I am attempting to create a Valhelsia 3 server and keep running into this error on startup

I have tried JDK 8 from oracle and adoptium with no luck.

for example minecraft 1.21.8 code for the golden apple is
